by purchasing from me youre agreeing to my terms below ✦

  • a deadline for the commission to be finished must be stated beforehand

  • all payments must be done 100% UPFRONT IN CAD

  • progress on the commission will not start until payment is received

  • hide your address when paying through paypal as it is not required

  • send payment under goods & services

  • all work is deleivered ditigally only

  • you may request that i send an invoice directly

please let me know if youd like to receive regular progress updates. i typically send a sketch for confirmation before proceeding but im happy to provide updates at each stage if you prefer ✦

✦✦✦ CANCELLATIONS ✦✦✦

  • if you are considering submitting an inquiry please notify me via email beforehand. this gives me the best opportunity to provide updates to those who may be concerned about any unintentional delays

  • a full refund can only occur if a commission is incorrectly paid for due to miscommunication

  • art commissions may not be refunded if the commission is already complete and approved by the client

  • refunds may be issued if i am mentally or physically unable to complete the commission due to its complexity and deadline

  • no refunds can be done after the sketch has been made and approved by the client

  • if i have not started on the commissions yet you are allowed to cancel the commission and you will be refunded as soon as possible

i will not tolerate any harassment or pressure that makes me uncomfortable ✦

  • other forms of digital currency will not be accepted

  • hate speech towards groups / people

  • anything otherwise inappropriate or offensive subjects: sexual abuse / bestiality / glorified self-harm & abuse / pedophilia / heavy drug abuse / anything politically related

  • fetishization against children / real people and real animals

  • real people unless theres proof provided beforehand that its consensual or a gift

  • highly unrealistic or extremely obese or muscular characters

  • offensive humor

  • disabled characters / prosthetics, mobility aids / etc

  • artistic nudity / doll nudity / and slightly suggestive themes [ provided with ID ]

  • gore & bodyhorror / blood / scarring / amputated limbs / disfigurements

  • landscapes / buildings / cities / graphic design

completion time for commissions may take up to 3 to 6 months also depending on significant changes to the commission will incur additional waiting and extra fee ✦

THIS INCLUDES BUT NOT LIMITED TO ⬎

  • costume or character replacements

  • highly detailed designs / outfits or backgrounds added mid-process

  • any modifications requiring a substantial rework of the artwork

  • requests for additional characters to be included

  • unclear or incomplete references

  • adding new elements such as props effects during production

as an artist i ask for patience throughout the process. im always happy to answer questions and youll be informed of any delays. please note that i take time to recover between commissions ✦

  • mental health issues

  • creative and mental fatigue

  • current commission queue

  • artwork complexity

  • physical strain from long drawing sessions [ hand and wrist or back ]

  • external responsibilities [ work or family matters ]

if youre concerned about a delayed response you may send a follow-up message. i may be resting socially and mentally to prevent burnout and ensure consistent quality for all clients ✦

as the artist . . . i retain full copyright to the artwork i create ✦

THEREFORE . I RESERVE THE RIGHTS TO ⬎

  • reject your commission if i dont feel comfortable with the subject / deadline / etc

  • use the artwork to promote myself across any platform or site by defualt

  • use the commissioned work in a portfolio

  • post speedpaint video of the commissioned work

YOU . AS THE CLIENT ⬎

  • may NOT use the commissioned work for profit or merchandise

  • may NOT use the commissioned work in anything related to AI training and fetish mining or other means of reproducing my work

  • you may alter or transform. if only given permission and used for personal fair use.

  • noncommercial use only. reproducing and using my artwork for commercial use without my consent or knowledge unless paid for is prohibited

  • may print the artwork and retain rights to their original character(s) but not to the artwork itself

  • may promote yourself with the commissioned work in your own social media / website with proper credit

✦✦✦ USE OF ADOPT ✦✦✦

review these terms before making any purchase. these may be updated at any time and apply retroactively to previous adopt purchases. if you have any questions or need clarification feel free to reach out! ✦

  • have fun with em! they are yours to enjoy

  • if a design is purchased without commercial usage rights it may not be used for any income-generating purposes. this includes but is not limited to; VTubing . game characters . and merchandise. no revenue may be derived from the design

  • you can draw a design only after purchasing it

  • after the paid the invoice ill send over the high resolution jpeg via email if requested

  • you may add the adopt to your stories and modify or adjust the design that doesnt discredit me

  • you are NOT allowed to remove my watermark and steal my designs

  • i retain the copyright to the artwork and this means that the character is yours but you were not the one to designed it

  • i would appreciate being credited in a place where people can see it if they need to find that information quickly

  • i can use the design as a portfolio and post the artwork on my sites

✦✦✦ ADOPT HOLDS ✦✦✦

  • longer holds are available to regular customers only [ defined as clients who have purchased 3 or more designs ] while new clients are limited to a maximum hold of 2 weeks

  • all holds must be requested in advance and are subject to approval on a case-by-case basis

  • holds are permitted for up to one week and may be decreased to a maximum of five days in the event of an emergency

  • if a hold expires without payment, the design will be relisted for sale

✦✦✦ RESELLING ✦✦✦

  • gifting / trading designs / re-selling are allowed

  • do not resell the character immediately after purchase

  • re-sold designs will not be eligible for commercial use

  • you may resell your adopt at the original purchase price or lower

  • selling it for a higher price is only allowed if you include the cost of any additional commissioned artwork or extras youve paid for

  • for ownership transfers please let me know beforehand who the new owner is so i know its not stolen

  • when re-selling do not change the status of the designer

✦✦✦ CO-OWNERSHIP ✦✦✦

  • co-ownership is allowed provided all terms are followed. co-ownership is limited to a maximum of two individuals

  • the primary owner is solely responsible for all communication and coordination between co-owners

  • if co-ownership is used to bypass a blacklist- specifically by involving a blacklisted individual- both parties will be blacklisted and the design will be reclaimed and relisted for sale
